What benefits are owed upon dismissal without cause?
Upon dismissal without cause, the worker is entitled to: salary balance, proportional 13th salary, proportional vacation + 1/3, overdue vacation + 1/3 (if any), notice period pay, 40% FGTS penalty, FGTS withdrawal, and unemployment insurance (if eligible).
What changes with mutual agreement (CLT Art. 484-A)?
In a mutual agreement, created by the 2017 Labor Reform, the worker receives half the notice period pay, a 20% FGTS penalty (instead of 40%), can withdraw 80% of FGTS, but has no right to unemployment insurance. Other benefits (salary balance, 13th, vacation) are paid in full.
What happens if I resign voluntarily?
Upon resignation, you receive: salary balance, proportional 13th salary, proportional vacation + 1/3, and overdue vacation (if any). You do NOT receive: FGTS penalty (40%), FGTS withdrawal, unemployment insurance, or compensated notice. You must give 30-day advance notice or have the amount deducted.
